Sorry lesbians...

First off, it's hard for y'all to get married, then once you get married, you can't get a divorce like the rest of us divorced losers....talk about unfair....

Couple married in Massachusetts files for state?s first same-sex dissolution

PROVIDENCE, R.I. - A lesbian couple married in Massachusetts has filed for divorce in Rhode Island, setting up a legal conundrum for judges in a state where the laws are silent on the legality of same-sex marriage.

Margaret Chambers and Cassandra Ormiston of Providence were married after the Massachusetts Supreme Court legalized gay marriage in 2003, making it the only U.S. state allowing same-sex couples to wed.

Chambers' attorney, Louis Pulner, said Wednesday the couple had irreconcilable differences, and filed for divorce Oct. 23 in Rhode Island family court.

Because it's legally recognized only in MA, not in RI.

Well if it's not legally recognized in RI then they were never married there in the first place so they wouldn't have to file for divorce anyways. Right?

There's no definitive answer to that question yet, hence the conundrum.

Kind of what I was thinking. Unless they move back to Mass. and/or want to marry someone else, in which case they would have to divorce there.

I wonder how it worked with health coverage, life insurance stuff, etc. Since they were married only in MA I wonder if they were to move to another state and be able to get a separate civil union with someone else. It's all really confusing.

Okay, but isn't there some law saying a marriage that is legal in the state in which it is performed must be recognized by all other states? (this law was enacted to protect the marriage rights of interracial couples, I believe)

How does that affect gay marriages performed in MA?

If memory serves, Congress passed and good 'ol dubya signed something saying that states were not required to recognize gay marriages performed in other states.

your memory is 1/2 correct. Congress did pass the Defense of Marriage Act but it was good 'ol Slick Willy who signed it.
